Two accused of jumping man as he left a birthday party

First-degree assault charges have been filed against two people accused of attacking a man who was leaving a birthday party in July.

Andrew Charles Thalacker, 26, 2101 Fifth Ave. S.W., is charged with one count of first-degree assault resulting in great bodily harm. He is to make his first court appearance Dec. 3.

Noah Robert Swancutt, 17, 1014 Sixth Ave. S.E., is charged in juvenile court with one count of first-degree and one count of third-degree assault. Prosecutors have asked to try him as an adult, and a hearing on that motion is set for Nov. 16 in juvenile court.

Both defendants are accused of jumping a 23-year-old Rochester man as he left a birthday party in the 1700 block of HIllview Lane Southeast on July 26.

According to the criminal complaint, the man went to the party with a female. She told police they had been at the party about half an hour when she was told to get her boyfriend out "because no one liked him."

The woman told police that Thalacker attacked her boyfriend as they were leaving. She said that her boyfriend fell down and Thalacker continued punching him. She said three or four other males joined in the assault. Witnesses said Thalacker and Swancutt punched the victim five to 10 times while he was on the ground.

The victim was treated at Saint Marys Hospital for facial fractures, broken ribs and a broken tooth. The victim told police that three to five people stomped on his head.
