MANTORVILLE -- A Byron man has again been charged in Dodge District Court with three counts of first-degree criminal sexual conduct for allegedly having sexual contact with a girl during a 14-year period.
Terry John Hulbert, 54, was charged Oct. 29.
Three charges that were filed in December 2008 were dropped about a month ago because of the illness of a county investigator who is a key prosecution witness. The county said it couldn't guarantee a speedy trial and dismissed all three charges with the intention of refiling them.
Having to drop charges and then re-file "is a first," said Gary ReMine, assistant Dodge County attorney. But he couldn't continue to delay without risking getting the case thrown out, he said.
Each count alleges that the victim was at least 13, but younger than 16, and that Hulbert was at least four years older than the victim.
The girl was 22 when she made a report to authorities.
