Felony charges

• Brandon Lee Nord, 25, Stewartville, charged with financial transaction card fraud and gross misdemeanor identity theft in September. A summons has been issued to be in court Jan. 8.

• Elmo Lawrence Albertelli Jr., 45, Pine Island, charged with domestic assault by strangulation, misdemeanor domestic assault on Dec. 3. Unconditional bail is set at $50,000, conditional bail at $25,000. He returns to court Dec. 16.

• Octavio Daniel Gomez, 24, Dodge Center, charged with two counts of second-degree controlled substance crime and three counts of third-degree controlled substance crime for allegedly selling narcotics in July and August. Unconditioanl bail is set at $160,000, conditional bail at $100,000. He returns to court Dec. 22.

• Jon Michael Clemens,24, Eyota, charged with two counts of first-degree controlled substance crime, one count of fifth-degree controlled substance crime, misdemeanor no proof of insurance when driving, misdemeanor driving after suspension, all on Dec. 14. Unconditional bail is set at $50,000, conditional bail at $25,000. He returns to court Jan. 8.

• Cody Ray Haakenson, 20, 211 Sixth Ave. N.W., No. 1, Rochester, charged with fourth-degree controlled substance crime, fifth-degree controlled substance crime, misdemeanor no proof of insurance when driving, on Dec. 12. He has been released on his own recognizance and returns to court Jan. 5.

• Joshua Charles Mollert, 32, Byron, charged with fifth-degree controlled substance crime in September. A summons has been issued to be in court Jan. 22.

• Kaila Sue Miller, 20, 3515 15th Ave. N.W., Rochester, charged with theft of a diamond ring and receiving stolen property in February. A summons has been issued to be in court Jan. 22.

• Trisha Ann Reicks,20, Cresco, Iowa, charged with check forgery, two counts, in January. A summons has been issued to be in court Jan. 22.

• Nicole Marie Maldonado, 21, 362 Elton Hills Drive N.W., No. 22, Rochester, charged with two counts of second-degree controlled substance crime and three counts of third-degree controlled substance crime in July. She is accused of conspiring and aiding others in the sale of drugs. A summons has been issued to be in court Jan. 22.

• Aaron Michael Still, 21, Stewartville, charged with two counts of felony domestic assault, one count of felony making terroristic threats, gross misdemeanor interfering with a 911 call on Dec. 17. Unconditional bail is set at $30,000, conditional bail at $15,000. He returns to court Dec. 22.

Felony dismissals

• A felony second-degree assault charge has been dismissed against Stephanie Lynn Cardone, 43, of Rochester. Assistant Olmsted County Attorney Rick Jackson dismissed the complaint Dec. 12 saying the state could not locate an essential witness. She was charged in August with the felony count as well as two misdemeanor domestic assault charges. They also were dismissed.

Misdemeanor/gross misdemeanor dispositions

• Gross misdemeanor driving while impaired with 0.08 blood-alcohol concentration within two hours of driving — Gary George Jones, 57, 3582 Sixth St. N.W., Rochester, sentenced Nov. 6, 2008, to pay $1,085.

• Gross misdemeanor driving while impaired — Joel Anthony Kyek, 29, 811 First St. S.W., Rochester, sentenced Nov. 6, 2008, to pay $985.

• Gross misdemeanor driving while impaired with 0.08 blood-alcohol concentration within two hours of driving — Nathaniel Miller, 37, Holy Springs, Miss., sentenced Nov. 6, 2008, to 30 days in a combination of jail and home detention with credit for any time served, pay $1,115.

• Gross misdemeanor driving while impaired — Vicky Lynn Tolliver, 48, 825 W. Silver Lake Drive, Rochester, sentenced Nov. 6, 2008, to 30 days in a combination of jail and home detention with credit for any time served, pay $900.

• Obstructing the legal process, two counts — Alexander Edward Ou, 20, 1926 491⁄2 St. N.W., Rochester, sentenced Nov. 7, 2008, to pay $700.

• Gross misdemeanor driving while impaired with 0.08 blood-alcohol concentration within two hours of driving — Jared Richard Byrnes, 28, Cresco, Iowa, sentenced Nov. 12, 2008, to pay $1,115, serve 30 days in a combination of jail and home detention.
