NOTICE AND ORDER FOR HEARING ON PETITION FOR FORMAL ADJUDICATION OF INTESTACY, DETERMINATION OF HEIRS AND APPOINTMENT OF PERSONAL REPRESENTATIVE AND OBJECTION TO PURPORTED WILL OF DECEDENT AND NOTICE TO CREDITORS
IT IS ORDERED AND NOTICE IS GIVEN that a hearing will be held for the adjudication of intestacy and determination of heirship of the Decedent, and for the appointment of Wesley M. Bussell, whose address is 670 South Avenue SE, Eyota, Minnesota 55934, as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration, and finding that the Decedentâ€™s Will dated May 03, 2019 is invalid. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.
IT IS ORDERED, that due to the COVID-19 pandemic and pursuant to Minnesota Supreme Court Order ADM20-8001, the Petition will be heard on October 28, 2021, commencing at 3:30 p.m., by this Court by electronic zoom hearing. The Court will notify the Petition and others who may enter an appearance (or their attorneys, if applicable), with further information regarding remotely attending this hearing at least two business days prior to the hearing.
If you are not the petitioner (or petitioner's attorney, if applicable) and wish to appear at the hearing to object, please contact the Court by phone at (507) 722-7264 by 4:30 p.m. no later than
October 26, 2021 , 2021, and thereafter arrangements will be made for you to appear by telephone or other remote means.
Additionally, if you object to the relief sought you must file written objections with the Court Administrator by 4:30 p.m. no later than October 26, 2021 , 2021. Objections can be mailed with the applicable filing fee to this Court at the Olmsted Government Center, 151 Fourth Street SE, Rochester, MN 55404, or electronically filed in the electronic filing system.
Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
