Fraud charges dismissed

Felony charges were dismissed Thursday against a Rochester man accused of conspiring to defraud his homeowner insurance carrier.

William Eugene Rosenthal, 65, 3254 Lake Ridge Drive N.W., had been charged in May with attempted defraud of an insurer, attempted theft and conspiracy to defraud an insurer.

The charges were dismissed against Rosenthal in Olmsted District Court at the request of Assistant Olmsted County Attorney Pamela Hester.

Hester told Judge Joseph Chase that it was doubtful the state could successfully prosecute the case.

Elements needed to pursue the case were not present, Hester said outside the courtroom. The charges couldn't be proven beyond a reasonable doubt, she said.

The same charges could be filed again if "more evidence was to surface," Hester said.
