High court won't review child death case

The Minnesota Supreme Court has denied a request to review the case of a Rochester woman serving time in prison for causing the death of an 18-month-old toddler.

Marilyn Jane Erickson, 56, took her appeal to the Supreme Court after the state appeals court upheld her conviction in June. On Thursday, the Supreme Court said it would not hear the case.

An Olmsted District Court jury found Erickson guilty last year of causing the death of Sabrina Elizabeth Lee in June 2001. Doctors testified during the trial that the toddler died of head injuries consistent with having been shaken. Prosecutors said Erickson shook the toddler to get her to stop crying. It happened during a short time when Erickson was alone caring for children at her sister's daycare center.

Jurors found her guilty of second-degree unintentional murder. She was sentenced to 121⁄2; years in prison.
