The criminal case against a Rochester man accused of breaking into a home in February 2002 and assaulting a woman with tear gas has been dismissed because the prosecution can't locate a necessary witness.
Richard Allen Dalton, 25, 1455 Marion Road S.E., No. 207, had faced three counts of first-degree burglary, one count of making terroristic threats, two counts of felony fifth-degree assault and one felony count of prohibited possession of tear gas.
A complaint alleged Dalton entered a home along North Broadway on Feb. 11, 2002, and assaulted a woman with tear gas and made threats.
