A 22-year-old man who failed to register as a sex offender now will serve time in prison.
Dodge District Judge Lawrence Agerter ordered a seven-year prison term in the case of Russell Elliott Waldschmidt, no address.
Waldschmidt was convicted of first-degree criminal sexual conduct in Dodge County in 1997 and given a stayed sentence. New criminal charges were filed against him in Olmsted County after he failed to register as a sex offender. Agerter found that Waldschmidt had had other violations since his original sentence. He revoked the stay during sentencing Aug. 6, 2002, and ordered him to serve the 86 months.
He also ordered him to serve 17 months on the Olmsted County charge, to run concurrently. Waldschmidt will be given credit for any time served.
