Man gets probation in plea deal for sexual assault

A 42-year-old Rochester man will serve 30 days in jail and be on probation for two years after pleading guilty to a gross misdemeanor criminal sexual conduct charge.

Terrence William Maki Jr., 3519 Kelsey Lane S.W., pleaded guilty in February to the gross misdemeanor fifth-degree criminal sexual conduct charge as well as a misdemeanor domestic assault charge.

Under the plea agreement, four counts in a separate file — felony fourth-degree criminal sexual conduct, gross misdemeanor fifth-degree criminal sexual conduct and two misdemeanor counts of domestic assault — were dismissed. All of the charges stemmed from alleged conduct on March 23, 2009.

He returned to court April 12 for sentencing and Olmsted District Judge Joseph Chase stayed a one-year jail term on condition that he serve 30 days in jail with work release privileges. He is to attend a sex-offender program and comply with all terms of probation. He is to pay $985 in court fines and fees. A 90-day jail sentence on the misdemeanor domestic assault conviction was stayed.
